Welcome to Fitrah Care Collective ("we," "us," or "our"). By accessing or using our website, services, or consultations (collectively, the "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not use our Services.

2. SCOPE OF SERVICES
Fitrah Care Collective provides health navigation, faith-aligned wellness coaching, education, and consulting services. We do not provide direct medical care, diagnose, treat, or prescribe medication. By using our Services, you are not establishing a doctor-patient relationship, and our Services are not intended to diagnose or treat diseases. The advice you receive from your healthcare professional should supersede any information you may encounter on our platform or Services. Our Services, including the Content, should not be considered medical advice. Recommendations from our team and users should be taken as opinion, and you should always consult an appropriately qualified healthcare professional for diagnosis and treatment. Fitrah Care Collective does not represent or warrant that any particular medication or treatment is safe, appropriate, or effective for you. We do not endorse any specific tests, medications, products, or procedures.

3. ELIGIBILITY
By using our Services, you confirm that you are at least 18 years old or have the consent of a parent or legal guardian. You agree to provide accurate and complete information when using our Services.

4. ACCOUNT REGISTRATION AND SECURITY
Some Services may require account registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

5. PRIVACY POLICY

6. VIDEO CALLS AND HIPAA COMPLIANCE
Our video consultation sessions comply with HIPAA regulations to ensure the protection of your health information. While we implement standard security measures, you acknowledge that no online system is completely secure. By using our Services, you accept the potential risks associated with online communication and HIPAA-compliant platforms.

7. PAYMENT TERMS

  • Payment is required at the time of booking for consultations, coaching, and other paid Services.

  • We accept major credit cards and other payment methods as listed on our website.

  • All transactions are securely processed, and we do not store payment details.

  • Services are non-refundable unless otherwise stated.

8. CANCELLATION & REFUND POLICY

  • Clients may reschedule appointments with at least 24 hours' notice.

  • Cancellations made less than 24 hours before an appointment are non-refundable.

  • Refunds for other services are granted at our discretion on a case-by-case basis.

9. INTELLECTUAL PROPERTY RIGHTS
All content provided through our Services, including text, graphics, logos, videos, and educational materials, is owned by Fitrah Care Collective or used with permission. You may not copy, reproduce, or distribute our content without prior written consent.

10. THIRD-PARTY LINKS & SERVICES
Our website or Services may contain links to third-party websites or recommendations for third-party products. We do not endorse or assume responsibility for any third-party content, products, or services.

11. USER CONDUCT & PROHIBITED USES
You agree not to:

  • Use our Services for illegal, fraudulent, or harmful activities.

  • Share confidential information of others without permission.

  • Attempt to disrupt or hack our platform.

12. TERMINATION OF SERVICES
We reserve the right to terminate or suspend access to our Services if you violate these Terms or engage in harmful or unlawful activities.

13. WARRANTY DISCLAIMERS & LIMITATION OF LIABILITY
THE SERVICES ARE PROVIDED “AS IS” AND ARE FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE SERVICES OR ANY CONTENT ON THE SERVICES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, FREEDOM FROM COMPUTER VIRUS, AND ANY IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE IN TRADE.

IN NO EVENT SHALL FITRAH CARE COLLECTIVE, ITS AFFILIATES, CONTRACTORS, OR THEIR RESPECTIVE OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, INCLUDING BUT NOT LIMITED TO LOSS OF SALES, GOODWILL, OR DOWNTIME, ARISING UNDER TORT, CONTRACT, OR OTHER LAW. IF LIABILITY IS FOUND, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (1) THE TOTAL FEES PAID BY YOU FOR OUR SERVICES IN THE SIX (6) MONTHS PRIOR TO THE CLAIM OR (2) $500.

14. INDEMNIFICATION
You agree to defend, indemnify and hold harmless Fitrah Care Collective, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

15. MANDATORY ARBITRATION & CLASS ACTION WAIVER
Any disputes arising from these Terms shall be resolved through final and binding arbitration under the Rules of Arbitration of the American Arbitration Association. By using our Services, you waive your right to a trial by jury and agree that any claims must be brought in your individual capacity, not as a plaintiff or class member in any class action or representative proceeding.

16. FORCE MAJEURE
Fitrah Care Collective shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, power failures, labor disputes, or government actions.

17. SEVERABILITY
If any part of these Terms is found to be invalid, void, or unenforceable, the remaining provisions shall remain in full force and effect.

18. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Fitrah Care Collective and supersede all prior communications, whether electronic, oral, or written.

19. CHANGES TO THESE TERMS
We may update these Terms from time to time. Any changes will be effective immediately upon posting on our website. Continued use of our Services constitutes acceptance of the revised Terms.
